Legal agreement governing your use of Faceswap

Welcome to Faceswap. By downloading, installing, or using the Faceswap mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Faceswap ("we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any modifications.
Faceswap is an AI-powered mobile application that allows users to swap faces in photos and videos. The App uses advanced machine learning algorithms to process images locally on your device.
We provide the following features:
You must be at least 13 years old to use Faceswap. If you are between 13 and 18 years old, you represent that you have your parent or guardian's permission to use the App.
By using the App, you represent and warrant that:
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on iOS devices you own or control, solely for your personal, non-commercial use.
You agree NOT to:
You retain all ownership rights to photos and videos you upload to the App. Since all processing happens on your device, we never access, store, or claim any rights to your content.
You agree not to create or share content that:
Face swapping technology is powerful. Please use it responsibly and ethically. Do not create content intended to harm, defame, or deceive others. Always respect others' privacy and obtain consent before using their likeness.
You are solely responsible for any content you create using the App and any consequences of sharing that content. We are not liable for any claims arising from your use of the App or content you create.
The App, including all software, algorithms, designs, text, graphics, and other content (excluding user-generated content), is owned by Faceswap and protected by copyright, trademark, and other intellectual property laws.
Our trademarks and trade dress may not be used without our prior written consent. All other trademarks appearing in the App are the property of their respective owners.
Faceswap offers optional premium subscriptions that provide access to additional features. Subscription details, including pricing and duration, are presented in the App.
All payments are processed through Apple's App Store. By purchasing a subscription, you agree to Apple's payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
You may cancel your subscription at any time through your iOS Settings. Refund requests are handled by Apple according to their refund policy. We do not directly process refunds.
Your privacy is important to us. Our Privacy Policy explains how we handle your information. By using the App, you consent to our privacy practices as described in the Privacy Policy.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.
We are not responsible for content you create using the App or how you choose to use or share that content. You assume all risks associated with creating and sharing face swaps.
You agree to indemnify, defend, and hold harmless Faceswap, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.
Upon termination:
We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without notice. We are not liable to you or any third party for any modifications, suspensions, or discontinuations.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits or class-wide arbitration.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Faceswap regarding your use of the App.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
No waiver of any term shall be deemed a further or continuing waiver of that term or any other term.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
